NiceSale (NS): Terms of Use, Members/Users Agreement and Privacy Policy.
The following describes the terms on which NiceSale offers you access to our services.
By using the services available from the domain www.NiceSale.com (the "Site") you are agreeing to the following terms with NiceSale.com, NiceSale and or NiceSale Inc. (NiceSale) (NS) and the general principles for the web sites of our subsidiaries and or affiliates. If you reside outside of the United States, you are contracting with NiceSale on USA terms and or International terms if applicable. Throughout this agreement “Member” and “User” are to be considered interchangeable and or one in the same when necessary or desired by NiceSale.
Before you may become a member/user of NiceSale, you must read and accept all of the terms and conditions in, and possibly linked to, this Terms of Use, Member/User Agreement and the Privacy Policy. We strongly recommend that, as you read this Member/User Agreement, you also access and read the possible linked information. All member/users agree to all the statements NiceSale makes in reference to new business concepts and processes and or patent pending business processes or designs developed by NiceSale.
This Agreement is effective on October 1st, 2006 for all Members/Users.
Using NiceSale
While using the Site, you will not:
• Post content or items in an inappropriate category or areas on the Site;
• Violate any laws, third party rights, or our policies
• Use the Site if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Site.
• Fail to deliver payment for items purchased by you.
• Fail to deliver items purchased from you.
• Manipulate the price of any item or interfere with other Member's listings.
• Circumvent or manipulate our fee structure, the billing process, or fees owed to NiceSale or a member.
• Post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
• Take any action that may undermine the fagging system or any other NS system.
• Transfer your NiceSale account (including feedback) and Member ID to another party without our consent. Contact NiceSale for Account Transfer details*
• Distribute or post spam, chain letters, or pyramid schemes;
• Distribute viruses or any other technologies that may harm NiceSale, or the interests or property of NiceSale members or users.
• Copy, modify, or distribute content from the Site and NiceSale's copyrights, patents, patents pending and or trademarks; or
• Harvest or otherwise collect information about Members, including email addresses, without their consent.
Abusing NiceSale
NiceSale and it’s community work together to keep the site working properly and safely. Please report problems, offensive content, and policy violations to us.
NiceSale works to ensure that listed items do not infringe upon the copyright, trademark or other rights of third parties. If you believe that your rights have been violated, please notify us and we will investigate.
Without limiting other remedies, we may limit, suspend, or terminate our service and Members accounts, prohibit access to our website, remove hosted content, and take technical and legal steps to keep Members or users off the Site if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies and or missions. We also reserve the right to cancel unconfirmed accounts.
Content License
When you post content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights you have in the content, in any media known now or in the future. (We need these rights for you to host and display your content within your NiceSale membership account.)
Liability
You will not hold NiceSale responsible for other Members' actions or inactions, including things they post. You acknowledge that we are like a traditional classified service and we have new unique, patent pending, non-traditional way of promoting and selling goods and services including NiceSale’s services. The Site is a venue to allow anyone to offer, sell, and buy just about anything, at anytime, from anywhere, in a variety of pricing formats and venues. NiceSale is not involved in the actual transaction between buyers and sellers, however NiceSale also promotes itself and it’s services with it’s own promotional sales. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction. NiceSale itself is considered a member like any other when it comes to any sales or promotions.
We do not transfer legal ownership of items from the seller to the buyer, and nothing in this agreement shall modify the governing provisions of New York and the other 49 states and or any country, under which the seller transfers legal ownership of an item upon physical delivery of the item to the buyer. Unless the buyer and the seller agree otherwise, the buyer will become the item's lawful owner upon physical receipt of the item from the seller, in accordance with New York and the other 49 States and or countries laws. Further, we cannot guarantee continuous or secure access to our services, and operation of the Site may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our Site. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Regardless of the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the fees you paid for our services within the last 12 months. Those fees would be returned wholly less any commission and or rewards received. Once all fees within the last 12 months are returned the party is considered to be made whole and can not seek any other restitution.
Release
If you have a dispute with one or more Members, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a New York resident, you waive New York Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
Access and Interference
The Site contains robot exclusion headers. Much of the information on the Site is updated on a real-time basis and is proprietary or is licensed to NiceSale. All users and or members agree that you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission from NiceSale Inc.
Additionally, you agree that you will not:
• Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
• Copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for Your Information) from the Site without the prior expressed written permission of NiceSale and the appropriate third party, as applicable.
• Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site.
• Bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site.
Privacy
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described within. We view protection of Members' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. Our security is of the highest level. Our servers sit on a US military base, which is literally protected by video surveillance and heavily armed military personnel. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. We use third parties to verify and certify our privacy principles. If you object to your Information being transferred or used in this way please do not use our services.
Indemnity
You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
No Agency
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Notices
Legal notices shall be served to the email address you provide to NiceSale during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent. Alternatively, we may give you legal notice by mail to the address provided during the registration process. In such case, notice shall be deemed given three days after the date of mailing.
Resolution of Disputes
If a dispute arises between you and NiceSale, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and NiceSale agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections within or as you and we otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution by contacting us at Complaints@nicesale.com. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
• Law and Forum for Disputes - This Agreement shall be governed in all respects by the laws of the State of New York as they apply to agreements entered into and to be performed entirely within New York between New York residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against NiceSale must be resolved by a court located in Onondaga County, New York, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Onondaga County, New York for the purpose of litigating all such claims or disputes.
• Arbitration Option - For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by NiceSale; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
• Improperly Filed Claims - All claims you bring against NiceSale must be resolved in accordance within the guideline within this Agreement. All claims filed or brought contrary to this Agreement shall be considered improperly filed. Should you file a claim contrary to this Agreement, NiceSale may recover all attorneys' fees and costs, provided that NiceSale has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.
Additional Terms
The following policies are part of this Agreement and provide additional terms and conditions related to specific services offered on the Site:
Due to NiceSale commitment to its Missions concerning charities, the environment and it other interests, certain activities, practices etc. may be frowned upon and considered contradictory to the mission of NiceSale and or its members. NiceSale reserves the right and can hinge all and or some membership privileges including commissions and or rewards and or “membership” on a member’s willingness to comply with the overall missions of NiceSale. These Mission’s may change at different times and it is the responsibility of the member to stay informed of NiceSale’s Missions. Failure to comply with the Missions may result in fines, loss of membership privileges and or cancellation of membership and all its privileges including commission and reward payments. All payments and or rewards are considered commission payments.
All earned rewards are earned based on the terms and use guidelines set fourth in the Terms and use agreement you as a member electronically signed to become a member. The goods you may have received as a result of the guidelines set fourth by NS are subject to recall or cancellation and any or all of the costs associated with those items may be owed to NS or one of its members if the guidelines of the terms and use policies set fourth by NS are or were not followed. If in any way unscrupulous or unapproved methods of earning commission or goods were employed, NS reserves the right to demand the monies or goods to be returned immediately and proper compensation be made to NS for any deprecation or loss in value be incurred to that asset and any legal or other collection costs associated in collection of those monies, goods, etc, are to be collected as well.
NiceSale Membership is a privilege not a right and can be revoked at anytime for any reason. NiceSale is committed to having members that conduct themselves within the highest ethical and moral standards. Any conduct by a member deemed by NS to be unsavory may result in fines, commissions and or rewards being recalled, and or forfeited and or membership and or membership privileges being revoked temporarily and or permanently. In extreme cases of misconduct an individual member could affect the privileges of members around them. Members are strongly to encourage to conduct themselves professionally and ethically because their actions could result in not only their privileges and or membership being affected but it could also affect the person or persons that introduced them and or as well it could affect the person or persons that they introduced.
NiceSale makes no claims that any of the “potential” earnings of monies or rewards are possible for anyone or everyone. NiceSale is simply committed to representing the numbers as they calculate within basic math formulas. Offers may change at any time and it is the members and or users responsibility to be aware of changes to offers, rules or terms of use guidelines set fourth by NiceSale.
NiceSale is a business and members are to conduct their own business independent of NiceSale. NiceSale takes no responsibility for what its members or users do. NiceSale members are independent representatives of their “own company” and do not represent NiceSale directly. No member can claim that they are speaking for NiceSale. It is the responsibility of the members or users to gather the information they need to determine if what another member or user is truthful or accurate.
NiceSale is an open market place like many other open classified mediums. NiceSale takes no responsibility for the items listed and or the descriptions made about those items and warranties nothing. Items banned by NiceSale are prohibited and any listing of those items could result in loss of membership privileges, fines, reward withdraws, membership termination and or criminal charges being filed by the authorities if warranted.
NiceSale will always attempt to do it’s best to police our site. We encourage everyone to report miss conduct. We will do our best to keep NiceSale a safe and equitable service for all.
NiceSale will be paying commissions in the form of money or material rewards to members and those commissions are paid with no legal responsibility or connection to the receiver. NiceSale is not liable for anything the receiver does, and NS does not protect against fraud or warranty any good or services that the receiver of the commission provides.
NiceSale strictly prohibits the sale of: guns or weapons that are illegal or that require licenses in any state or country, drugs, drug paraphernalia, animals, people, illegal pornography, and or anything illegal. If you wish to give away dog, cats, etc, you are welcome to do so but no money can exchange hands except direct donations to animal welfare organizations.
NiceSale requires that all the personal information a member provided be 100% accurate. Due to the fact that are paying out commissions we are required by Federal and State law to issue W-9’s and 1099’s and therefore we must insure that your personal information is absolutely accurate. Providing inaccurate information may be in violation of Federal and State laws and you may face criminal charges. Commission cannot be paid out if your personal information is not 100% accurate. Inaccurate information may also result in fines, penalties, membership privileges and or membership being revoked and all commissions and earned goods being forfeited and or recalled.
Commissions and or rewards not paid or collected before the end of the calendar year, or the dates provided in the NS terms of use, may be lost. NiceSale places the responsibility solely on the member to provide the personal information necessary to payout commissions. Failure to provide that information in a timely manner may result in loss or forfeiture of any or all commissions and or rewards. It is the responsibility of the members to comply with all state and federal tax paying and reporting laws.
Joining order etiquette is important to maintain for everyone. Give credit to the person that told you and explained NiceSale to you, that keeps it fair. There is no difference in the order you join or the timing in which you join or the person that you join under. The only difference is what you decide to do with NiceSale. NiceSale is your “own business” and it is what you make of it. NiceSale may impose fines, penalties, membership restrictions and even close member accounts if improper joining order is practiced. Members may be reassigned or repositioned if necessary. When a member joins and later discovers that their positioning was improper due to ethical reasoning or other reason, it is possible that they may be repositioned upon request. NiceSale cannot guarantee that repositioning can take place and there may be fees or charges associated with that task. These requests will only be considered as a last resort and the requests may or may not be considered. NiceSale strongly encourages members to position ethically and correctly from the start.
NiceSale will have employees and or representatives that work directly for NiceSale Inc. These employees will also be members and as members they are subject to the same membership terms of use agreement and privacy policy.
At times NiceSale membership may be offered to you thru your employer. If your employer offers NiceSale to you as an employee benefit and pays for your membership your employer may be extended certain rights or powers over your membership and the membership privileges. It is possible that upon request to NiceSale an employer may have the option of controlling your membership and the privileges it carries. Ex: If you are offered a NiceSale coupon to join NiceSale paid by your employer and your performance as an employee comes into question due to NiceSale or any other reason, your employer may request to NiceSale any degree of membership penalties including membership cancellation. NiceSale does not guarantee to anyone or any entity that those penalty requests made will be executed or enforced.
Outage Policy
NiceSale’s highest priority is to its members and users and to the services we provide to them. However, the NiceSale site will occasionally experience outages during which members and or users cannot use the services. NiceSale is sorry for any member or user inconvenience. At this time we cannot offer any compensation, correction or remedy for any problems that arise do to outages.
Prohibited, Questionable & Infringing Item Policy
Find out if your item is allowed. As a NiceSale member or user, you are ultimately responsible for making sure that buying or selling an item is legal in the eyes of the law.
Forum Usage Policy
The NiceSale forums were created to provide a place where members can connect with other members, receive support, and learn more about NiceSale’s missions, it’s members and the way they use, enjoy and benefit from NiceSale. NiceSale hope everyone finds the forums helpful, educational and enjoyable. Please be courteous and respectful to all participants when posting.
The NiceSale Community is made up of NiceSale members, users, buyers and sellers, as well as NiceSale staff. The NiceSale Community encourages open and honest communication among all its’ people. You'll find that respect and communication is “Key” to NiceSale's dynamic Community. The highest moral and ethical standards are expected within our community.
NiceSale values
The NiceSale Community is guided by fundamental values:

NiceSale is firmly committed to these principles. And we believe that community members should also honor them—whether buying, selling, or chatting with NiceSale friends.
Listing Policy
Familiarize yourself with NiceSale’s listing policies before posting an item. You'll have a safe and fun selling experience knowing that your listing complies with community standards and guidelines.
Listings that violate NiceSale’s policies may result in disciplinary action. This action may include a formal warning, the ending of all violating listings, or even temporary or indefinite suspension of a members account. NiceSale will consider the circumstances of an alleged offense and the member’s records before taking action.
Investigations
The NiceSale Investigation teams try to resolve reported cases of inappropriate activity. NiceSale will consider the circumstances of an alleged offense and the member’s record before taking action. Disciplinary action may range from a formal warning up to indefinite suspension of a members account. However, out of fairness to all members, if a complaint cannot be proven with certainty, NiceSale will not take action. Members must keep in mind that NiceSale can result in long-term residual income and no member wants to risk losing that income. Complying with NiceSale’s policies is very important in order to not jeopardize that income.
Real Estate Policy
Selling an undivided interest in a land real estate property is not permitted. An undivided interest is defined as a partial interest by two or more people in the same property. This prohibition shall not apply to mineral rights.
All policies could change from time to time. Changes take effect when we post them on the Site. When using particular services on the Site, you are subject to any posted policies or rules applicable to services you use through the Site, which may be changed from time to time. All such policies or rules are hereby incorporated into this Agreement.
General
NiceSale Inc. is located at in, Syracuse, New York. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement elsewhere. Headings are for reference purposes only and do not limit the scope or extent of such sections. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.
We may amend this Agreement at any time by posting the amended terms on the Site. All amended terms shall automatically be instantly effective when they are initially posted on the Site. Additionally, we may notify you through the Site's message center tools. This Agreement may not be otherwise amended except in a writing signed by you and us. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The following Sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content License, Liability, Indemnity and Resolution of Disputes.
Non-Disclosure/Confidentiality Agreement
Every member agrees to hold all internal working of NiceSale confidential in relation to all NiceSale processes and designs and or patent pending designs, concepts and structures. The services provided on the surface can be shared to fully explain and utilize the services for the benefits of all members or members to be. The sharing of the internal workings of NiceSale business concepts and designs not needed to fully utilize and benefit from the services with non-members is prohibited.
Non-Compete
Members and users agree to a Non-compete agreement upon becoming a user or a member. They agree to not compete or work with any one or any company or organization that competes or tries to compete in a like manner with NiceSale in any way. They agree to not be involved in any way with a company or organization that competes or attempts to compete with NiceSale utilizing NiceSale’s processes or Patent Pending processes. No member shall start up, invest in or financially benefit from any other company or organization utilizing processes or designs similar to NiceSale. This non-compete shall be the longest allowable time enforceable within any state in the US and or any country. To be upheld and enforceable from 2-5 plus years or indefinitely, which ever is longer.
Commissions, Rewards and Dream Teams
NiceSale considers all commission and or rewards to be compensation offered or provided to a member with the member being considered a completely independent representative. All commissions and or rewards are reported to the IRS and any necessary state agencies as income and are represented as that on 1099’s and other necessary or related paperwork. Within this agreement the terms “rewards” and or “commissions” can be considered one in the same and interchanged to mean the same thing upon NiceSale’s desires, or the contrary.
Upon agreeing to a “Dream Team” competition each person or entity agrees to the terms stated at the time of the specific Dream Team and or the terms within this agreement. Dream Teams are a competition at first and then a team effort to reach a total group sales volume. Individuals or individual entities must employ conventional methods of membership recruiting and signing to reach the sales goals. They cannot sign people up themselves in bulk; they must have the individual member sign up. For example: If a company had 200 employees they could offer a coupon to each employee they want to offer the service to but it would be the responsibility of that individual employee to sign up, the company or a company representative could not sign up those new members without that employee present and actively involved. NiceSale requires that members enrolling to satisfy a Dream Team must be available for individual and group training. Groups must be available for training in groups no smaller than 10% of the total over all group size goals. Ex: group size goal = 200, group minimum training size = 20.
Dream Team members are obligated to be an active member “team player” in order to accomplish the over all goals of the Team. If at anytime a Dream Team member is deemed as not capable of reaching the team goals, that team member can be removed from the team and or replaced. Reasons can be but are not limited to health problems, family problems, conflicts or any nature, lack of motivation, lack of skill, etc. Team members can also request another member or members be removed, but it is ultimately the decision of NiceSale. Dream Teams members are only give credit toward the goal for signing paying members, non-paying customers like not for profits and charities do not count toward the sales goals.
All commissions and or rewards are earned thru good ethical business practices as outlined in this agreement but not limited to this agreement. At anytime if it is determined for any reason that a member or user is manipulating the system or business in way anticipated or not anticipated by NiceSale and or any of its employees or representatives NiceSale reserves the right to cancel memberships, cancel commissions, cancel rewards, withdraw commission and or rewards, discontinue payment for commissions and or rewards, etc. NiceSale also reserves the right to recover any and all expenses incurred in the recover of those commissions and or rewards including any legal or collection fees.
Once a member has chosen a reward to pursue, they cannot change that course without written permission from NiceSale. Members also cannot get multiple rewards along the way to certain rewards. Ex: If a member is pursuing an Ipod 30G, they must forgo the Ipod rewards that come before that sales goals on the way to the 30G. In other words they cannot earn both the 1G and or 2G along the way to a 30G. If the choose the higher goal and reward they no longer eligible to take the lower rewards. Members should request what they want and have the sales to support the reward they are requesting. Ex: if you choose to join a Dream Team to pursue a car, rewards along the way at lower sales levels may no longer be available and you will not be able to go back and lower your reward requests.
If a member earns commissions and or rewards and their downline erodes at a rate of 5% or more after earning those commissions and or rewards NiceSale reserves the right to investigate the reasons for the erosion and may withdraw and or cancel payment of that commission and or reward. Any erosion of downline may indicate manipulation of the NiceSale system and or unethical means of recruiting or selling or using of the NiceSale services and system. It is the decision of NiceSale to determine the actions in dealing with this problem.
Other Terms and examples:
The new car is selected from the rewards choices and is a 24-month lease or more in which NiceSale pays the down payment, taxes and the monthly payments. The winner is responsible for insurance and any mileage over the allotted amount outlined in the lease and they are responsible for all the terms of the lease for the lease is in their name. Winners must qualify for the lease contract under their name. Winners that don’t qualify can transfer their reward to another person of their choice in order to qualify for the lease. That person must qualify for the same terms stated within and stated within the lease. NiceSale takes no responsibility or liability for the outcome of any situations that arises due to the lease or and earned commissions or rewards. It is the lessees’ responsibility to live up to the terms of the lease. NiceSale simply pays the standard costs associated with the standard 24-month or more lease. All terms stated in the lease relating to damage, etc, etc are the responsibility of the leaser signed on the lease, not NiceSale or any of its representatives.
Winner can also opt for the cash option. They can take 75% of the value of the potential lease and receive that in cash in monthly installments for the life of the lease term or they can opt for Fast Cash, 4 lump sum payments over 4 months at 50% value. NiceSale reserves the right to change the terms of these rewards at any time for any reason.
These earned gifts are considered marketing tools for NiceSale and its members. Certain insignias and or logos may be placed on the vehicles and must stay on the vehicles for the term of the lease. Removing those items may result in forfeiting of the lease and NiceSale may discontinue paying for the lease.
The agreement that the winner makes with NiceSale upon accepting the gifts requires that the vehicle remain in use and on the road and driven regularly to gain exposure. Taking the car off the road or parking it for long periods of time, more than 2 weeks, may result in forfeiting of the lease and NiceSale may discontinue payment for the lease.
Other terms and conditions may exist. Terms and conditions may change at any time and it is the responsibility of the members to make themselves of the changes.

Any expenditure a member makes to market or promote their development of the NiceSale business is at their own risk and own expense. None of those expenses can ever be considered recoverable for any reason at any time. Neither NiceSale nor any of its representatives suggest anyone spend anything that they don’t want to spend. All expenses incurred are the sole responsibility of that member or individual.
NiceSale and all members/users acknowledge and understand that neither NiceSale nor anyone can anticipate the outcomes of this new cutting edge business model. Due to NiceSale’s new business model, a model not ever employed, NiceSale’s members and or users agree that all the terms of this agreement must be 100% flexible both past, present and future and NiceSale reserves the right to back date any changes at any time. NiceSale’s terms are subject to change at any moment before and after the fact and that all members must abide by all changes made past, present and future. NiceSale makes no guarantees of anything, including but not limited to anything within this document or outside this document.
